1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Streak ("Company," "we," "us," or "our") concerning your access to and use of the Streak mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the App.

2. Description of Service

Streak is a nutrition tracking and periodized diet planning application designed to help users achieve their body composition goals. The App provides:

  • Personalized nutrition plans based on your goals (fat loss, body recomposition, lean bulk)
  • Daily calorie and macronutrient tracking
  • Calorie cycling with different targets for training and rest days
  • AI-powered food photo analysis
  • Barcode scanning for packaged food logging
  • Progress tracking and streak-based motivation
  • Apple Health integration for weight data sync
  • Cloud synchronization across devices

3. Eligibility

You must be at least 16 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have obtained parental or guardian consent to use the App.

4. Account Registration

To access certain features of the App, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or incomplete.

5. Subscriptions and Payments

5.1 Free Trial and Pro Subscription

The App offers a free trial and premium ("Pro") subscription:

  • Free Trial: 7 days of full access to all Pro features, no credit card required
  • Pro Monthly: 4,99€ per month
  • Pro Yearly: 29,99€ per year (save 50%)

Pro includes: personalized nutrition plans, calorie cycling, AI food photo analysis, barcode scanning, unlimited history, and cloud sync across devices.

5.2 Billing

Pro subscriptions are billed through the Apple App Store. By subscribing to Pro, you agree to pay the applicable fees. Prices are displayed in your local currency and may vary by region.

5.3 Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your Apple ID account settings.

5.4 Refunds

Refunds are handled by Apple according to their refund policy. We do not have the ability to process refunds directly. To request a refund, please contact Apple Support.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to the App, other accounts, or our systems
  • Interfere with or disrupt the App's functionality or servers
  • Reverse engineer, decompile, or disassemble any part of the App
  • Use automated systems (bots, scrapers) to access the App
  • Share your account credentials with others
  • Upload malicious content or attempt to compromise our security
  • Use the App to harass, abuse, or harm others
  • Misrepresent your identity or affiliation

7. Health Disclaimer

IMPORTANT: The App is designed to help you track nutrition and is NOT intended to be a substitute for professional medical advice, diagnosis, or treatment.

  • Always consult with a qualified healthcare provider before starting any diet, nutrition program, or exercise regimen
  • The calorie and macro recommendations provided are estimates based on general formulas and may not be suitable for everyone
  • If you have an eating disorder, history of eating disorders, or other health conditions, please consult a healthcare professional before using this App
  • Do not disregard professional medical advice or delay seeking it because of information provided by the App
  • We are not responsible for any health consequences resulting from your use of the App

The AI food analysis feature provides estimates and may not always be accurate. Always verify nutritional information when accuracy is critical.

8. Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, and the design, selection, and arrangement thereof) are owned by us, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9. User Content

You retain ownership of any content you submit to the App (such as food photos for AI analysis). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store such content solely to provide and improve our services.

You represent that you own or have the necessary rights to any content you submit and that such content does not violate any third-party rights.

10. Third-Party Services

The App integrates with third-party services including Apple Health, Google Sign-In, and food databases. Your use of these integrations is subject to the respective third parties' terms and privacy policies. We are not responsible for the practices of third-party services.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any information provided through the App.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL STREAK, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Streak and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

14. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease. You may also delete your account at any time through the App settings.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Austria.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Streak regarding your use of the App and supersede all prior agreements and understandings.
